Schroeder Presents at Indiana Farm Bureau Zoning School

On February 10, 2022, Indiana Farm Bureau held an Agriculture Planning and Zoning School where Brianna Schroeder, along with two other speakers informed participants on zoning procedure and hot topics. 225 registrants, including county officials, attorneys, farmers, and landowners, participated in the free virtual event sponsored by the Indiana Agricultural Law Foundation. 

Jim Federoff of Snyder Morgan Federoff & Kuchmay, LLP kicked off the workshop after introductions by Indiana Farm Bureau General Counsel, Mark Thornburg, and Director of Indiana Agricultural Law Foundation, John Shoup. Federoff’s presentation consisted of a thorough outline of the history, procedures, and statutory guidelines of Planning and Zoning. 

Brianna followed with Hot Topics in Agricultural Zoning. Topics included solar energy, moratoria, and spite structures. Schroeder discussed defining solar energy systems in a zoning ordinance and ways to encourage organized solar development. Concluding, she addressed the importance of planning bodies and officials adopting a comprehensive plan to serve as a goal document for the jurisdiction. 

Alan Townsend of Bose McKinney & Evans, LLP concluded with a presentation on Judicial Review of Board of Zoning Appeals (“BZA”) decisions. Highlights from Townsend’s presentation included information on the BZA’s structure and judicial review, in which the trial court functions as an appellate court to BZA decisions should the applicant or remonstrators elect to appeal.
